Since Congress passed the Religious Land Use and Institutionalized Persons Act of 2000 (RLUIPA), dozens of suits against local governments across the country have been brought by religious organizations. The aim of these federal suits has been to force municipalities to permit exceptions to local zoning and land use laws.  RLUIPA is game-changing legislation that municipalities cannot afford to ignore because it usurps local government rights to enforce land use and zoning laws. In the words of Professor Hamilton, “[RLUIPA] attacks land use law, which is the proper province of cities and towns and states - not of the federal government. There is not a more direct attack on state sovereignty on the books.”
